The MP-elect for Obuasi East takes the EC to court over a second collation and declaration.

Samuel Aboagye, the declared winner of the Obuasi East parliamentary election, is contesting the Electoral Commission of Ghana’s (EC) activities regarding a second collation and results declaration in a judicial review application that will be heard by the Accra High Court.

As an interested party, Patrick Boakye Yiadom is named in the lawsuit against the EC, which raises questions about purported irregularities in the process.

Elikplim L. Agbemava, Samuel Aboagye’s attorney, is asking the court to: • Declare the EC’s second collation and results announcement on December 21, 2024, void.

Direct the EC to publish the results of the December 8, 2024, collation, which he says pronounced him the winner based on Form 1D, bearing the signatures of all participants.
Prevent the EC from publishing any results that differ from those on the original Form 1D by issuing an injunction.
Make sure Patrick Boakye Yiadom does not pretend to be the elected MP for Obuasi East.

Public Elections Regulations, 2020 (C.I. 127), according to the petitioner, forbid a second collation or declaration following the official results release.

He also makes the case that the candidates’ agreement on Form 1D, which summarizes election results, is legally obligatory and cannot be changed without their approval.

According to Aboagye, he was first proclaimed the victor of the election held on December 7, 2024, and any party who is unhappy with the outcome should contest it through the legal system.

Court Two of General Jurisdiction will hear the case tomorrow.
